Terms of Use for CardCalc

These Terms of Use (the "Terms") apply to the CardCalc mobile application (the "App") developed by Phuongnam Le (the "Developer"). CardCalc is provided as a freemium service.

By downloading, installing, or using the App, you agree to be bound by these Terms. Please read them carefully before using the App.

1. License to Use

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You may NOT:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or attempt to extract the source code
Remove or alter any copyright, trademark, or proprietary notices
Rent, lease, sell, or sublicense the App
Use the App for any illegal or unauthorized purpose

2. Subscription Terms

Pro Subscription

CardCalc offers an optional Pro subscription with the following terms:

            Price: $5.99 USD per 3 months
Billing: Auto-renewable subscription charged to your Apple ID
Payment: Charged at confirmation of purchase
Renewal: Automatically renews unless canceled at least 24 hours before the end of the current period
Management: Manage or cancel anytime in your device Settings → Apple ID → Subscriptions

        

Free Features

Basic functionality is available for free without a subscription. The free version includes:

Simple Mode with single entry calculations
Basic buy/sell and trade calculations
All core calculation features

Pro Features

The Pro subscription unlocks:

Advanced Mode with buy/sell and trade modes
Ability to create/save unlimited entries
View and edit entry history
Custom names for entries

Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period
No refunds for partial periods
Access to Pro features continues until the end of the paid period

Price Changes

The Developer reserves the right to change subscription prices with 30 days' notice. Price changes will not affect existing subscribers until their next renewal period.

3. Refund Policy

All subscription purchases are made through Apple's In-App Purchase system. Refund requests must be made directly to Apple according to their refund policy.

To request a refund:

Go to reportaproblem.apple.com
Sign in with your Apple ID
Find your CardCalc subscription purchase
Select "Request a Refund"

The Developer does not have the ability to process refunds directly.

4. User Responsibilities

Device Security

You are responsible for maintaining the security of your device
We recommend keeping your device's operating system updated
Jailbreaking or rooting your device may cause the App to malfunction and is done at your own risk

Data and Internet

The App functions offline and does not require an internet connection for calculations
Internet connection is only required for subscription purchases and restoration
You are responsible for any data charges from your mobile provider

Device Compatibility

The App is designed for iOS devices
You are responsible for ensuring your device meets minimum requirements
The App may not function properly on modified or unsupported devices

5. Intellectual Property

All rights, title, and interest in the App, including all copyrights, trademarks, trade secrets, and other intellectual property rights, belong exclusively to the Developer.

The CardCalc name, logo, and all related designs are trademarks of Phuongnam Le.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

The Developer does not warrant that:

The App will be error-free or uninterrupted
Defects will be corrected
The App is free of viruses or harmful components
Results obtained from the App will be accurate or reliable

Use for Information Only: CardCalc is a calculation tool designed to assist with card trading calculations. The Developer is not responsible for any financial decisions or transactions made based on calculations performed in the App.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Damages resulting from your use or inability to use the App
Any errors or inaccuracies in calculations

Your sole remedy for dissatisfaction with the App is to stop using it and uninstall it from your device.

8. Updates and Changes

App Updates

The Developer may release updates to improve functionality, fix bugs, or add features
You are encouraged to keep the App updated to the latest version
Some updates may be required to continue using the App
The Developer is not obligated to provide updates indefinitely

Terms Updates

The Developer may modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms. Your continued use of the App after changes constitutes acceptance of the new Terms.

We will update the "Last Updated" date at the top of these Terms when changes are made.

9. Termination

By You

You may stop using the App at any time by uninstalling it from your device. This does not automatically cancel active subscriptions.

By Developer

The Developer reserves the right to:

Discontinue the App at any time without notice
Modify or restrict access to any features
Terminate your access if you violate these Terms

Upon termination:

Your license to use the App ends immediately
You must delete the App from your device
Active subscriptions will remain active until expiration (no refunds)

10. Governing Law

These Terms are governed by the laws of the United States and the State of Louisiana, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Lafayette, Louisiana.

11. Age Restrictions

You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with parental or guardian consent.

The Developer does not knowingly collect information from children under 13.

12. Third-Party Terms

Apple Terms

Your use of the App is also subject to Apple's Terms of Service and App Store Terms and Conditions. In case of conflict, Apple's terms take precedence regarding your relationship with Apple.

Acknowledgment

You acknowledge that:

These Terms are between you and the Developer only, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support for the App
Apple is not liable for any claims related to the App
Apple is a third-party beneficiary of these Terms regarding your use of the App

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.
